Probate litigation

Includes contesting or defending wills, trusts, and trust amendments; it also includes challenging assets transferred by the Decedent prior to death such as by gift, joint and survivorship, POD, or other beneficiary designations. We also deal with farm inheritance disputes, breach of fiduciary duty disputes, and other inheritance, wealth, or estate disputes.

Will Contests

Primarily, will contests involve questions of undue influence or incapacity of the Decedent and whether the will is valid. The three month statute of limitations provides a very short time frame to contest a will.

Trust and Trust Amendment Contests

Trust and trust amendment contests also involve questions of undue influence and incapacity of the Decedent and whether the trust documents are valid.

Will and Trust Construction

These cases involve the interpretation of conflicting or confusing language in the will or trust.

Breach of Fiduciary Duty Cases

These cases usually occur where a trustee, executor, or person holding a power of attorney acts in his own personal interest to the detriment of the person he is supposed to be serving.

Pre-Death Gift and Transfer Cases

These cases involve questionable gifts or other transfers of assets during lifetime, often involving abuse of powers of attorney. Other examples under this group include: (1) changes to ownership of financial accounts by changing account designations to "joint & survivorship", "Payable-on-Death", or "Transfer on Death", and (2) changes to the beneficiary designation on a life insurance policy or other financial account.

Farm Inheritance Disputes

In these situations, we deal with disputes over farms, often involving wills, trusts, or transfer of the real estate by deed. There are typically very unique issues involved in these cases.

Other "Inheritance Disputes"

Include combinations of all those areas listed above.
