Several possible examples: an entire estate that is left to charity, while children are left out; an estate is left entirely to a second spouse with nothing to the natural children; an entire estate is left to a caregiver; and, unequal distribution of an estate among children.

In instances where a will divides property equally among children, but a trust, gift, or change of beneficiary designation transfers substantial property to one child prior to the parent's death, a Declaratory Judgment Action can be filed with the Probate Court. It asks the court to determine if the transferred property should be included in the estate and distributed according to the will.
